Discrimination or Model X part recall?

Here's the notice:

We are emailing to inform you of a proactive action Tesla is taking to ensure your safety as a Model X owner. Tesla's internally conducted crash testing demonstrates that Model X will be the first SUV to receive the highest safety rating in every category, and we are committed to ensuring that it remains the safest SUV in the world.

Recently, during an internal seat strength test that was conducted prior to the start of Model X deliveries in Europe, the recliner in a third row Model X seat unexpectedly slipped. The recliner, which is provided to us by an outside supplier, is the locking hinge that allows the third row seat back to fold forward, and if a recliner were to slip during a crash, the seat back could move forward. Similar testing was conducted before the start of deliveries in North America, with 15 confirmation tests having been conducted without a single recliner failure. Despite these prior successful tests and no reports of a third row seat slipping in any customer vehicles, we have decided to conduct a voluntary recall as a precautionary measure and will be replacing all affected third row seat backs.

Our records show that you own a Model X affected by this voluntary recall. We will shortly send you an official recall notice by mail, but we wanted to alert you to this action as soon as possible.

A fix to this issue is already in place. We have worked with our supplier to develop a new recliner design with improved quality that resolved the issue. We are now constructing new third row seat backs to match all affected vehicles. Your service center will contact you to schedule the installation of your replacement seat backs as soon as they are available. Based on current production rates, we expect all replacements to be completed on a rolling basis over the next five weeks. We will accelerate this timing if possible.

Until the recall is performed, you may make full use of your Model X, although we ask that you temporarily not have anyone sit in the third row seats while the car is in use. We recognize that not having the use of your third row seats for the next few weeks will be an inconvenience, but your safety is our primary concern. We assure you that we are building your new seat backs as fast as we can.

Thank you for being a Tesla customer. If you have any questions, please contact us by phone at 844-248-3752 or by email at [email protected]. We apologize for this inconvenience.

This thread is already off topic and probably will get locked, so I'm just going to get this in here beforehand.

It is easy to jump on Ramo for jumping to conclusions because of his or her assumption about race. While in the end it was completely off base, at the same time we see that there were events that cause Ramo to reach this conclusion. The people who are telling him not to make the same conclusion I hope are not assuming that there's no racism anymore in the US. As the media and other events show there are examples of racism going on in the real world, though the degree and type is generally vastly different from what happened in the 50's and 60's.

I honestly think Ramo should have seen if anyone else experienced this issue to know for sure. But if someone has gone through a lot with regards to race, then I can see why they may assume something. (not justifying Ramo's actions, just trying to understand them). Ramo was wrong in this situation, but Ramo could be right in others.

What is the correct response? I honestly don't know. All we can really do is be open and talk about these things.

What is the correct response?

The correct response is to not automatically assume the other person is out to get you. Yes, even if you've experienced in the past that the other person was out to get you. (BTW, I have several times gone to make large purchases in my 'work' clothes (and not smelling like roses!). Nobody has ever had any issues taking my money and if I can give them a little watercooler fodder to chortle about, it's been a good day for all.

Automatically thinking badly of other people, particularly those whom you do not know personally, have had no prior engagements with, and are otherwise complete strangers, is the very best way to feed paranoia and give negativity the thumbs up to rule your life.

So in this very specific situation express your disappointment, believe the DS over looked the checklist as they said they did and that they weren't lying to you, and go have a beer/banana split/or whatever you do to cheer yourself up when you're bummed.

I find even though there are "known" issues with certain parts on the early production cars, those with a VIN less than 600, until you have a problem they don't replace the parts. This has now happen to me on three occasions including the latching mechanisms on the front and gulf wing doors, the charger port a
So I arrive at my delivery appointment today to receive my highly anticipated Model X. I am given the customary walk thru and orientation. I sign the contract and initial all the corresponding paperwork. I hand over my certified cashier's check and insurance card.

Then I am taken inside the car to be tutored on the remaining interface features. Once nearly done a second "delivery specialist" appears then promptly informs me that they can't release my car because of a "3rd row seat latch recall". Naturally, I was puzzled by this revelation being that this appointment was actually a reschedule from a week prior. I politely ask the specialist, "is this recall on all the X's?" She said, "No." Then I asked how she knew this was an issue on my model X? The "specialist" explained that it appeared on a checklist that she had that went unnoticed before. So has this happened to anyone else? Is there truly a model X 3rd row seat latch recall? Or did a certain specialist assume that because of my appearance (still had on trucking work clothes), and skin color that I wasn't trustworthy enough to release the car to?
This happened to me too but with me it was a cracked charging port, something that was on their "list" but had been missed. Since I was driving my Jaguar, was dressed much better than I normally am with an Amani sports jacket, blue jeans and Ferragamo boots and the fact I am blue eyed and blond I tend to make me think your DS was probably being honest. It happened to me again several weeks later, this time it was a problem with a power module for the headlights, then two weeks after that with an issue with the door latches. My deliver was delayed almost two months. All of these issues were on their "list" of things which needed to be checked. Throughout my life I have seen discrimination but I think based on my experience with Tesla your issue had more to do with production issues rather than discrimination.

FWIW, the recall became official this morning or earlier and I believe it's against Federal law to deliver a new vehicle w/an open recall.

From http://www-odi.nhtsa.dot.gov/acms/cs/jaxrs/download/doc/UCM499348/RCMN-16V138-9787.pdf (VW e-golf recall campaign 16V138000 for unexpected stalling/loss of propulsion), it says
IMPORTANT REMINDER ON VEHICLES AFFECTED BY SAFETY & COMPLIANCE RECALLS
New Vehicles in Dealer Inventory: It is a violation of Federal law for a dealer to deliver a new motor vehicle or any new or used item of motor vehicle equipment (including a tire) covered by this notification under a sale or lease until the defect or noncompliance is remedied. By law, dealers must correct, prior to delivery for sale or lease, any vehicle that fails to comply with an applicable Federal Motor Vehicle Safety Standard or that contains a defect relating to motor vehicle safety.
Pre-Owned Vehicles in Dealer Inventory: Dealers should not deliver any pre-owned vehicles in their inventory which are involved in a safety or compliance recall until the defect has been remedied.
Dealers must ensure that every affected inventory vehicle has this campaign completed before delivery to consumers.

LEFT

Just got an email from Tesla regarding a voluntary recall for 3rd row latch issues -- looks like your DES just doing his/her job.
