What do you think Tesla is in breach of? Do you have a contractual agreement with Tesla for uptime or production, and what does your contractual language say around consequential damages? From the warranty section of Tesla's standard form purchase contract (if they are your installer):

10. Limitation of Liability. If there is a dispute, the maximum amount that either of us will have to pay the other is the
price in the Price Sheet (as updated, if applicable) for anything arising out of these purchase terms. Also, neither of
us will have to pay the other for any indirect damages (what lawyers call “special or consequential damages”).
