Actually, if the Democrats attain 51 seats in the Senate they would control the agenda and could advance consideration of a nomination.
Or even 50 seats and the White House (because the VPOTUS is the President of the Senate and therefore breaks ties).

FWIW, the Iowa Electronic Markets currently has the odds of a Democrat-controlled Senate at 53%, Republican control at 40%, and the "Other" (e.g. 50/50) at 7%. IEM also has the Presidential election with 68% odds on a Democrat as the next POTUS, with Sec'y. Clinton at 89% odds for winning the nomination.

So...if IEM is a good indicator, then the most likely outcome is that Democrats will control both the White House and Senate next year. And even if the GOP controls the White House, it seems that a certain casino owner will be the one in the Big Chair, and who can predict whom he might nominate to SCOTUS. Today's Senate GOP leaders have some tough strategic choices to make.

Did you see that President Obama is considering an in-law relative of Speaker Ryan for the vacancy? Yet another twist.
