Sounds like they need to talk. I tend to take Tesla's side, but who knows? Then again, why buy an expensive car and then expect the company to back it? Can you do that with other high end cars?

Why not? Folks buy totalled cars all the time. They're totalled because the insurance company doesn't want to put the money into fixing it, not because they aren't able to be fixed at all.
