We have received complaints from TMC members that have been receiving promotional emails from a third party despite never having given said third party their contact information or permission to be contacted.

We would like to clarify to the TMC Community the following points:

1) Contact information of TMC members or users/viewers that were sourced from TMC or collected on lists linked/directed to from the TMC website (for the purpose of last years “TESLIVE” event), is the sole property of TMC and can only be used with TMC’s permission.

2) TMC did not give permission to said 3rd party to use your contact information for their own purposes. Last year TMC brought on various individuals and volunteers to work on behalf of TMC to help stage last year’s TMC event, “TESLIVE”. Said 3rd party was allowed, on behalf of TMC, to direct TMC users to signup forms and collect their contact information for the sole purpose of helping put on last year’s TMC event. The TMC user base is the intellectual property of TMC. TMC does not allow any separate entity to collect user information for their own purposes or possession without the expressed consent of TMC.

3) Their use of said contact information is a violation of TMC’s intellectual property rights. TMC has warned said third parties not to use TMC’s intellectual property on multiple occasions since November of 2013. Several of you have received emails sent to addresses reserved solely for TMC and to be used for Teslive registration or info lists, which has made it clear that the information has been reused and TMC’s IP abused.

4) TMC has a privacy policy which it abides by in order to provide you with a good user experience while protecting your privacy. In order to successfully implement our privacy policy, it is essential that our intellectual property rights are respected.Users who signed up for the TMC event, Teslive, naturally thought they were providing their information to be used solely at the discretion and control of TMC. The unauthorized use and possession of your contact information by a 3rd party, which presented itself originally as acting on behalf of TMC, is a violation of your privacy. You have the right to ask and demand that you be taken off their mailing lists.

5) TMC does not condone their use of your contact information. We are actively evaluating what actions, legal or otherwise, that we may take to immediately stop and prevent further abuse of your private contact information and TMC’s intellectual property.
